REMIT

 According to the Law of Ukraine “On the Natural Gas Market”, only entities registered as wholesale energy market participants in accordance with the procedure approved by the Regulator shall be entitled to carry out transactions with wholesale energy products. The registration procedure is available on the NEURC website.

Transportation Agreement

In accordance with the GTS Code provisions, obtaining the access to the gas transmission services is carried out on the basis of the transportation agreement only.

To conclude the natural gas transportation agreement, the Network User shall provide the TSO with:

• Application for the conclusion of the agreement;
• A scanned copy of the customer’s documents confirming the authority of the persons that represents a company, including authorized persons that will have an access to make transactions should be provided to the email address commercial@tsoua.com;
• Originals of the transportation agreement in two copies, filled in, signed by the network user and affixed with its seal.

List of documents for agreements conclusion – (Ukr-Eng) (9):

• a scanned copy of charter (articles of association) of a counterparty, which certified by an authorized person of the enterprise;
• extract from the Unified State Register of Legal Entities, received not later than 1 month before the date of the agreement conclusion;
• a scanned copy of order on the appointment of the head of the counterparty (director-general/chair of the board) certified by an authorized person of the enterprise;
• a scanned copy of protocol of the shareholders’ meeting on the appointment of the head of the counterparty (director-general/chair of the board) certified by an authorized person of the enterprise;
• certified scanned copies of documents to conduct the signature verification;
• a scanned copy of a Power of Attorney of the signatory of network user.

The network user’s documents shall be duly certified by an authorized person of the enterprise.

!!! In case the documents were executed in a foreign language, their certified translation into Ukrainian shall also be submitted.

Standard contract for the execution of work on the termination / resumption of natural gas transportation between the Gas Transmission System Operator and the Natural Gas Supplier

According to para 2 point 14 of section II of the Rules for the supply of natural gas, approved by the resolution of the National Commission for State Regulation in the Fields of Energy and Utilities No. 2496 of 30 September 2015, a supplier shall be entitled to take measures to limit or stop gas supply to the consumer through the involvement in these works the gas transmission system operator or gas distribution system operator. To do this, the supplier shall conclude an agreement with the TSO/DSO for the performance of work related to the interruption/restriction of gas supply to consumers.
